1 About us and our Website

1.1 Volunteer Development Scotland is a company registered in Scotland (Company No. SC106743) and having its registered office at Jubilee House, Forthside Way, Stirling, FK8 1QZ (“VDS”) and is a charity registered in Scotland with charity number SCO13740. In these Website Terms “we”, “us” and “our” means VDS.

1.2 Please read these Terms carefully as they set out the terms and conditions under which VDS makes available to you the use of our Services (as defined below) by means of its website at www.volunteerscotland.org.uk (“Website”). By using any of the Services and/or the Website you agree that you have read and accept these terms and conditions and that they shall apply to your use. If you do not wish to be bound by these Terms then please do not use this Website or register for any Services.

2 Services

VDS makes available an online volunteer recruitment and information service in terms of which third party organisations can place advertisements of placement opportunities which they have from time to time and which enables you, if you are interested in such opportunities, to respond the advertisements (the “Services”).

3 Registration

3.1 Please note that some Services will only be made available to you following completion by you of the registration section of the Website. The registration process will collect certain data from you and will require you to confirm that you accept these Terms.

3.2 Following registration you will be able to respond to advertisements and contact the third party organisations who have made those advertisements available. Please note that if you respond to any advertisements you will be redirected so as to deal directly with those organisations and as a result any responses, contact or correspondence between you and that organisation or any arrangements or contracts that may be formed or exist between you and that organisation is so between you and that organisation and not with VDS. VDS will not be a party to such arrangements or contracts and VDS will not be held liable for your responsibilities or liabilities arising out of or in relation to the same (save to the extent required by law).

3.3 Where you are asked to complete a registration form the personal details that you provide must be true, accurate and complete. You agree to notify us of any changes which are relevant to your registration.

4 Use of the Website and the Services

4.1 The Website and the Services are for personal and non-commercial use only. You may print parts of the Website for your personal, non-commercial use only.

4.2 You may not use any information from any directory or other listing or information retrieval service (if any) made available on the Website and/or the Services, in connection with any business or commercial undertaking (whether or not for profit).

4.3 Any other use of materials on the Website and/or contained in the Services (including without limitation reproduction for a purpose other than that noted above and any modification, distribution or republication) without the prior written permission of VDS is strictly prohibited. You also agree not to link to and/or frame the Website or any of the content of the Services for any purpose, unless specifically authorised in advance by VDS to do so.

4.4 You agree that you shall not use (and shall not permit any other person to use) the Website and/or the content of the Services to transmit or receive material which is obscene, threatening, menacing, offensive, defamatory, abusive, untrue, in breach of confidence, in breach of any intellectual property right (including copyright) or which may cause anxiety to others including racist or sexist content or material which otherwise violates any applicable law or regulation or code, or which makes excessive demands for bandwidth or contains any virus or which may otherwise impair or harm VDS’s computer systems or any third party computer system.

4.5 By using the Services, you hereby grant to VDS a royalty free, perpetual, worldwide, non-exclusive licence to display, copy, reproduce and make available on the Website (and otherwise deal with as necessary to provide to you the Services) any material and information which you may provide to VDS through your use of the Services.

5 Intellectual Property

Save to the extent expressly set out in these Terms, VDS does not grant any licence or other authorisation to use any trade mark, product names, company names or logos or any of its copyright works or other intellectual property rights of VDS or third party organisations by placing them on or making them available by means of the Website and/or the Services.

6 Availability of the Website and the Service

VDS does not promise full, uninterrupted or error free operation of the Website and/or the Services. All liability of VDS, its directors or employees howsoever arising for any loss whatsoever arising from your use of or inability to use the Website and/or the Services is excluded, insofar as it is possible to do so in law.

7 Liability

7.1 Save to the extent required by law, no representations, warranties or terms of any kind are made in respect of the Website and/or the Services or their contents (including, without limitation, any views or comment made). All information and/or data included in and/or on the Website, the Services and/or in any directory or other listings or information retrieval service made available on or by the Website and/or the Services has been so made available for guidance only.

7.2 Your use of any information and/or data is entirely at your own risk. Any and all liability of VDS, its directors, employees or other representatives howsoever arising for any loss suffered as a result of your use of the Website and/or the Services is expressly excluded to the fullest extent permitted by applicable law.

7.3 VDS make no warranty that the contents of any and all e-mails communicated through the Site are free from infection by viruses or anything else which has contaminating or destructive properties and shall, to the fullest extent permitted by applicable law, have no liability in respect thereof.

7.4 The Website and/or the Services may include links to websites and/or services owned and/or operated by third parties. These are provided for your convenience only and VDS is not responsible for and does not give any warranties or make any representations regarding any such websites and/or services and is not responsible for or liable in relation to the content or your use of such websites (save to the extent required by law).

7.5 You acknowledge that VDS is not responsible for third party content on the Website and that VDS cannot ensure that material presented on the Internet is legal. VDS will not limit access to material unless notified that it is illegal. In particular, you acknowledge that VDS is not responsible for and does not monitor the content of advertisements provided by third parties on the Website. However, VDS shall have the right to remove any postings, materials or other items on the Website which it believes may be illegal or which it determines to be inappropriate.

7.6 VDS will not be a party to any communications whatsoever between you and those responding to any use which you may make of the Services, although VDS reserves the right to monitor any such communications which are made by you or third parties by means of the Website and/or the Services.

8 Use of Personal Information

8.1 Your personal data will be collected and processed by VDS in accordance with its Privacy Policy. It can be found at www.volunteer.scot/privacy

8.2 The personal data collected may include, without limitation, your name, address, telephone and fax details, email contact address, and other data obtained from you from time to time.

8.3 Information may be gathered from your registration form(s) and/or your use of the Website and/or the Services including through “cookies”.

9 Cookies

A cookie is a small file which asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. 10 Termination

10.1 VDS may terminate, suspend or deny you access to the Website and/or Services immediately for any reason without incurring any liability whatsoever to you.

10.2 You may terminate your agreement to these Terms at any time by ceasing to use the Website and not re-visiting the Website.

11 Liability

11.1 Nothing in these Terms is intended to exclude or limit our liability for death or personal injury arising from our negligence or for loss or damage arising from fraud or for any other loss or damage for which our liability may not legally be excluded or limited.

11.2 Subject to clause, 11.1, in no event will we be liable to you under or in connection with these Terms for any indirect or consequential loss or damage, or for any loss of profits, opportunity or anticipated savings, whether caused by breach of contract (including the agreement made on these Terms), negligence, breach of any statutory duty, or arising in any other way. For the purposes of this paragraph, indirect or consequential loss or damage means any loss or damage not directly arising from the breach, negligence or other event.

11.3 Subject to Clause 11.1, all implied warranties or conditions in relation to the Website and/or the Service are hereby excluded to the fullest extent permitted by law.

12 General

12.1 You may not assign, transfer, sublet, lease or delegate all or any of your rights and obligations under these Terms without VDS’s prior written consent.

12.2 A failure by us to exercise or enforce any of the Terms shall not be deemed a waiver of any such right nor shall such failure operate so as to prevent the exercise or enforcement thereof or of any other right on any later occasion.

12.3 If any provision of these Terms or part thereof is determined to be invalid, unlawful or unenforceable, such provision, or part thereof, shall be severed from the remaining terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.

12.4 These Terms (and any document referred to herein) constitute the entire agreement between the parties in respect of their subject matter. VDS reserves the right to vary these Terms from time to time without consent or any requirement for prior notice. Such changes shall be posted on the Website. Changes in this manner shall be deemed to have been accepted if you continue to use the Website and/or the Services.

13 Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed and construed in all respects in accordance with Scots Law and that the Scottish Courts will have the exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and their subject matter or formation (including non-contractual disputes or claims).
